Criminal Defense and Domestic Violence

When Your Case Carries Criminal Consequences, You Need One Team.

When you are facing criminal charges — whether an indictment, an investigation, or even mere allegations tied to a domestic matter — the decisions made in the first days can define the outcome.

SeidenFreed now offers dedicated criminal defense, anchored by Andrew Olesnycky, Esq., a NJ Supreme Court–Certified Criminal Trial Attorney with over a decade of private criminal defense experience in federal and state court representing clients facing serious charges. As a former county Domestic Violence Unit supervisor, Andrew is one of few attorneys in private practice in New Jersey who has served as a Domestic Violence Unit supervisor and represents both plaintiffs and defendants in criminal and civil domestic violence matters.

Domestic violence charges and criminal allegations rarely stand alone. A restraining order can lead to criminal complaint. A divorce can collide with an indictment. When family law and criminal law intersect, you need attorneys who understand the nuanced intersection of these two distinct practice areas and who can represent you across every courtroom, without the risk of strategies working against each other.

WhyThis Expansion Matters

Domestic violence cases rarely stay in one courtroom. A restraining order hearing in family court can run parallel to a criminal complaint. A divorce can be entangled with allegations that carry both civil and criminal consequences. When family law and criminal law collide, clients need a team that can navigate both — without having to coordinate between separate firms, retell their story twice, or risk strategies that work against each other.

That is why SeidenFreed LLC has expanded its practice to include dedicated domestic violence representation and criminal defense, anchored by the addition of Andrew Olesnycky, Esq. as Partner. With Andrew’s arrival, SeidenFreed is one of the few New Jersey firms able to represent clients across the full scope of a domestic violence matter — family court restraining order proceedings, criminal charges and investigations, and the family law issues (custody, support, divorce) that so often surround them.

Partner — Criminal Defense & Domestic Violence

Andrew Olesnycky, Esq.

Andrew Olesnycky joins SeidenFreed as one of the few attorneys in New Jersey to have led a county prosecutor’s Domestic Violence Unit and to now represent both plaintiffs and defendants in criminal and civil domestic violence matters. As supervising assistant prosecutor in Union County, Andrew was bore ultimate responsibility for every domestic violence complaint filed in the county while overseeing investigations, indictments, and trials, training new prosecutors and police officers, and administering a 24-hour domestic violence hotline for law enforcement.

Andrew is certified by the Supreme Court of New Jersey as a Criminal Trial Attorney, a distinction held by fewer than 1% of attorneys statewide. He has represented clients in federal and state matters involving large scale theft and fraud, racketeering, cyber crime, official misconduct, tax fraud, drug distribution, arson, sexual assault, weapons offenses, and domestic violence, and has been recognized by Best Lawyers in America and named to the National Trial Lawyers’ Top 40 Under 40. He served as a certified domestic violence law instructor at the John H. Stamler Police Academy. Andrew’s background handling major cases informs how he handles every case, including those with relatively minor criminal consequences. Having represented multiple professional athletes, public and political figures, and licensed professionals, Andrew understands that even minor criminal penalties can carry significant secondary consequences for established professionals and prominent persons.

At SeidenFreed, Andrew represents both survivors of domestic violence seeking protection and individuals facing domestic violence or criminal allegations — bringing a rare, dual-sided understanding of how these cases are actually investigated, charged, and tried.

Criminal Defense

Andrew Olesnycky brings a decade of private criminal defense practice to SeidenFreed, representing clients in federal and state court against serious charges — with cases covered by national media including the New York Times, the Associated Press, and CBS This Morning. He is certified by the New Jersey Supreme Court as a Criminal Trial Attorney, a distinction held by fewer than 1% of attorneys statewide. Before entering private practice, Andrew served nearly five years as a Union County Assistant Prosecutor, giving him firsthand knowledge of how the government builds its cases — and where the weaknesses are.

Whether you are under investigation or already facing charges, early representation matters. We review every case with the rigor of a former prosecutor and the dedication of a defense team built to fight for you.

  • Domestic violence-related criminal charges
  • Fraud, theft, and white-collar offenses
  • Stalking and cybercrime
  • Official misconduct
  • Harassment, cyber-harassment, and speech-related offenses
  • Tax fraud
  • Assault, weapons, arson, and violent crime charges
  • Drug distribution and narcotics charges
  • Automobile-related offenses

Domestic Violence Representation

Domestic violence cases rarely stay in one courtroom. A restraining order or divorce hearing in family court can run parallel to a criminal complaint and choices about whether and how to testify can dramatically impact a litigant’s legal rights, carrying potentially dramatic civil and criminal consequences. SeidenFreed represents clients on both sides of a domestic violence matter — those seeking protection, and those facing accusations.

For Survivors of Domestic Violence Seeking Protection

If you are experiencing domestic violence, our attorneys help you understand your options and act quickly. We assist clients in obtaining Temporary and Final Restraining Orders, seeking assistance from law enforcement, navigating Family Part proceedings, and addressing the custody, parenting time, and support issues that frequently arise alongside a restraining order. Often, the filing of a domestic violence allegation by one party may trigger a counterclaim by the other party, turning the victim-survivor into a defendant. Every case is handled with sensitivity, discretion, and urgency.

  • Temporary and Final Restraining Order petitions and hearings
  • Coordinating protection with related custody, support, and divorce matters
  • Guidance through police reports, court procedures, and safety planning resources
  • Representation in related criminal proceedings against an abuser, where applicable
  • Prosecution of marital torts and Tevis claims

For Those Facing an Allegation

A domestic violence accusation can carry immediate and serious consequences — a restraining order hearing, loss of access to your home or children, firearms surrender, and the possibility of related criminal charges. Andrew Olesnycky’s background as a former domestic violence unit supervisor gives him direct insight into how these cases are built and prosecuted, and how to defend against them effectively in family, criminal, and administrative proceedings.

  • Defense against Temporary and Final Restraining Order applications
  • Motions to vacate Final Restraining Orders (Carfagno motions)
  • Representation in related criminal domestic violence charges
  • Domestic violence appeals
  • Protecting custody, parenting time, and firearms rights during proceedings
  • Strategic coordination between family court and criminal court matters
